Ignition Interlock Restricted License

Explanation:

The court may order a driver to install an ignition interlock device of a type approved by the Department of Motor Vehicles as a condition of their probation for an alcohol violation. Any such order by the court shall not take effect until the individual is eligible to operate a motor vehicle.

If a Driver has been revoked for a third time for a period of 15 years, they may apply to the Department of Motor Vehicles after serving at least seven (7) years of the withdrawal period - requesting the department to make a recommendation to the Board of Pardons for reinstatement of their eligibility for an operator’s license. If the reprieve is granted, the Driver is required to install an ignition interlock device of a type approved by the Department of Motor Vehicles for the duration of their original revocation period.

 

Eligibility:

1.If the driver was revoked for a 90-day Administrative License Revocation (ALR), the restricted license can be issued after of 30-days of the revocation have been served.

2.If the driver was revoked for a subsequent offense – they must be revoked for one (1) year prior to being eligible for the restricted license.

3.To be eligible, the driver cannot be suspended or revoked for any other reason.

 

Requirements:

To receive a letter authorizing the issuance of the restricted license, the driver must submit (a) a certified copy of the Probation Order issued by a Nebraska court allowing the installation of the ignition interlock device, (b) a current certificate of installation showing that an approved device has been installed – a separate certificate of installation will be required for each vehicle driver will be driving (device cannot be installed on a Commerical Motor Vehicle), (c) surrender their Nebraska license to this office and (d) pay any required reinstatement fees.
